if I get a cancellation of my crime, how I can say "no I have not got a criminal past?

I went to an interview for a job and I loved it. but today I received a phone call saying that I did not get the job because there was a crime of petty thief happened five years ago. planning IM to a strike for my application approved. 1) my question is, does it come to the company after the cancellation? 2) on the application Employment wondering if I have a criminal record I can say no and walk away? 3) How should I pay for cancellation without a lawyer? (I live in California) 3) IM planning a police officer. This offense will be to help a policeman? Please help Thanks guys.

It's a question difficult to answer, even with the knowledge of the Penal Code section 1203.4 (none of this seems to have before answering). Cancellation under this law in California do not remove the conviction from your record, but the record must show that the conviction was dismissed. There is case law that says you can say to potential non-governmental employees they were not guilty of the crime. However, the Judicial Council of California says you have to say that you were convicted, and sentence was dismissed. And basically, what you says it is likely that a potential employer will be able to view the file, because the documents are found in all types of databases. My advice has always been to respond that "a misdemeanor charge has been dismissed under section 1203.4 of the Penal Code. "There is no misrepresentation here.
